The purpose of this Website Privacy Policy (the “Policy”) is to tell you what information we gather on this website, with a home page located at smartgivers.org (the “Website”) and how we use that information. Use of the Website constitutes an agreement with this Policy as well as the Website Disclaimer and Terms of Use Agreement.

This Policy applies to the Website, which is owned and operated by Charities Review Council (“the Council”). This Policy does not apply to any other websites, and we make no representations as to the privacy practices of other websites. This Policy does not apply to information we collect through methods other than this Website.

The Council reserves the right, in its sole discretion, to modify, alter or otherwise update this Privacy Policy at any time. You will be notified of changes to the Privacy Policy via a notation next to the link to the Privacy Policy from the main page of the Website stating that the Privacy Policy is new and the date on which it was updated. The last date on which the Privacy Policy was updated was May 9, 2019. By continuing to use this Website after changes to the Privacy Policy are posted, you agree to these modifications, alterations and/or updates.

What Data We Collect and How We Collect It

In order to maintain our Website, operate our business, respond to requests, process and track donations and orders, and update account information, we collect a variety of information about Website visitors. This section describes the information we collect.

You can visit and browse this Website without telling us who you are or revealing any Personal Information. If you choose only to look at the Website and do not wish to make donations, request information, or take other actions that require providing Personal Information (as defined below), you need not provide any Personal Information.

Nonpersonal Information

Each time a computer visits this Website we may collect certain information from that computer. Personal Information

If you request information, send us an email, send us your name or other information, fill out certain forms that may appear on this Website, respond to a survey or provide feedback to us, sign up for an e-newsletter, apply for a job, place an order, or open an account on this Website, you may provide us with information such as your name, address, telephone number, purchase information, email address, communications preferences, or similar information (“Personal Information”). You can decline to submit personal information for any of our services, in which case the Council may not be able to provide those services to you.

If you want to make a donation to the Council using a credit card or other electronic payment method, we will collect additional Personal Information from you as required from our third-party donation processors, DonorBox, Stripe, and Converge, in order to validate your payment method and authorize the dollar value of your donation for payment. Information collected includes information regarding your credit card or other electronic payment account, such as name, card number, and other information needed to process the transaction. This information is used for verification of a valid credit card or other payment method and authorization for the value of the requested donation.

If you want to make a purchase using a credit card, we will collect additional Personal Information from you as required from our third-party payment gateway, Stripe, in order to validate your credit card and authorize the dollar value of your purchase for payment. Information collected includes information regarding your credit card account, such as name, card number, and other information needed to process the transaction. This credit card information is used for verification of a valid credit card and authorization for the value of the requested purchase.

How We Use and Share Data

We are the sole owners of the information collected on this site. We will not sell, trade, rent, or share your information with any third party outside of our organization, other than 1) as necessary to fulfill your request or provide our services to you; 2) in accordance with this Privacy Policy; 3) when we believe in good faith that disclosure is necessary to prevent harm or injury to ourselves, to you, or to others, such as in the event of product recalls, fraud, claims or other liability; or 4) to comply with a law, regulation, warrant, subpoena, court order, or other legal process that requires disclosure of information submitted to the Website. The ways we share, use, and protect information collected over this Website depend upon the type of information involved.

Nonpersonal Information

We do not link the nonpersonal information we collect about your visit to the Website to your personal information. We may use nonpersonal information to help us make the Website more useful to you and for other business purposes. We and our agents who help us with hosting and security use several physical, electronic, and procedural safeguards to help protect your information. However, there is no such thing as perfect security. You agree that 1) there are privacy and security risks to the Internet which are beyond our control; 2) the security, integrity, and privacy of any and all information exchanged between you and us through the Website cannot be guaranteed; and 3) we are not responsible for the unlawful actions of third parties.

Information Security

We take precautions to protect your information. When you submit sensitive information via this Website, your information is protected both online and offline.

Wherever we collect sensitive information (such as credit card data), that information is encrypted and transmitted to us in a secure way. We also restrict access to personal information to only the Council employees, contractors, and agents who need to know that information in order to operate, develop, or improve our services. These individuals are bound by confidentiality obligations and may be subject to discipline, including termination, if they fail to meet these obligations. We do not maintain record of sensitive information such as credit card numbers; this information is destroyed immediately after use.

We review our data collection, storage, and processing practices to ensure that we only collect, store, and process the Personal Information needed to provide or improve our services or as otherwise permitted under this Privacy Policy. If you need to update your Personal Information, please contact us using the contact information provided below and we will use reasonable efforts in our control to revise that information.

The Council would like to send you information about our services that you use or that we think you will like. If you have agreed to receive marketing and other communications, you may always opt out at a later date.

You have the right at any time to stop the Council from contacting you for marketing purposes. If you no longer wish to be contacted for marketing purposes, contact us using one of the methods below.

As part of providing you the services provided on the Website, we may need to provide you with certain communications such as service announcements and administrative messages. These communications are considered part of the services and your account, which you may not be able to opt out from receiving.

Your Right to Rectification

You have the right to request that the Council correct any information you believe is inaccurate. You also have the right to request the Council to complete any information you believe is incomplete. This Website is designed for an adult audience only. People under 18 years old must not use this Website for transacting business, purchasing, or making donations. We will not intentionally collect online any personal information (such as a child’s name or email address) from children under the age of 13. If you think that we have collected personal information from a child under the age of 13, please contact us as described below and we will delete that child’s information as soon as possible.

The Council may deny access to the site to anyone at any time in its sole discretion.

Applicable Law and Venue

This Privacy Policy shall be governed by, and construed and enforced in accordance with, the laws of the State of Minnesota, without giving effect to any principles of conflicts of laws.
